Employment Disputes

Old Towne Associates, P.C. represents individuals and select corporate clients in employment disputes involving the following laws:

Federal Law

  • Title VII – claims based on race, color, sex, religion, and national origin discrimination and claims of harassment or retaliation
  • 42 U.S.C. ยง 1981 – claims based on race discrimination or retaliation
  • Americans with Disabilities Act (ADA) – claims based on disability discrimination or retaliation
  • Age Discrimination in Employment Act (ADEA) – claims based on age discrimination or retaliation
  • Family and Medical Leave Act (FMLA): claims brought by eligible employees of covered employers concerning unpaid, job-protected leave for specified family and medical reasons, and/or denial of group health insurance coverage or retaliation
  • Fair Labor Standards Act (FLSA): claims based on unpaid wages, whether backpay or overtime
  • False Claims Act (FCA): claims brought by a whistleblower employee who is discharged, demoted, suspended, threatened, harassed, or in any other manner retaliated or discriminated against in the terms and conditions of employment by his/her employer because the employee investigated, reported or sought to stop an employer from engaging in practices which defraud the United States government

District of Columbia/Virginia Laws

  • D.C. Human Rights Act – claims based on race, color, religion, national origin, sex, age, marital status, personal appearance, sexual orientation, gender identity or expression, family responsibilities, genetic information, disability, matriculation, or political affiliation, and claims of harassment
  • Virginia Human Rights Act – claims based on race, color, religion, national origin, sex, pregnancy, childbirth or related medical conditions, age, marital status, or disability and claims of harassment
  • Virginia Payment of Wage Law – claims based on unpaid wages, whether backpay or overtime
  • Virginia Minimum Wage Act – claims based on minimum wage violations
  • Virginia Right-to-Work Law – claims based on an employer conditioning employment on an employee paying union dues, or denying work to an employee on the basis of the said employee’s membership or non-membership in a labor union
  • Virginia Equal Pay Irrespective of Sex Law– claims based on discrimination in pay based on gender
